While hearing the case on Tuesday, the Supreme Court said that not every private property is community property. SC overturned the decisions made after 1978 in which the socialist theme was adopted. It was said that for the common good, the government can claim rights over all private properties. Under the provisions of Article 39 (B) of the Constitution, it has now been decided that private property cannot be considered community property. They cannot even be distributed for public benefit.
